From Exchange myths that just won't die to deadlines that sneak up on you when you least expect them, we're here to help you avoid the real investment nightmares.
Read on... If you dare!
Some myths keep coming back from the dead... no matter how many times we bury them.
MYTH #1: "I have to Exchange into the exact same type of property."
BUSTED! Like-kind doesn't mean identical. You may be able to Exchange a rental house for commercial property, raw land, or another qualifying real estate investment.
MYTH #2: "I can sell my property, take the money, and decide to Exchange later."
DEAD WRONG! A properly structured Exchange needs to be established before closing. Taking possession or control of the proceeds can ruin your chance at tax deferral.
MYTH #3: "I have to Exchange all or nothing."
NOT SO FAST! Partial Exchanges are possible. You may still defer some gain even if you don't reinvest everything, although you could have a taxable portion.
Don't Let spooky misinformation haunt your investment decisions!
The Nightmare Before Closing
We still have clients who ask, "I just sold my investment property... Can I still do a 1031 Exchange?"
Cue the horror movie music.
Here's the scary part: If you've already received actual or constructive receipt of sale's proceeds, it may be too l late to use a 1031 Exchange.
Don't let your tax bill become a real-life nightmare.
The 45-Day Countdown...
There's No Escaping the Clock!
Some things are scarier than a haunted house. Like realizing it's Day 44 and you haven't identified a replacement property.
Once you close on the sale of your relinquished property, the clock starts ticking… and unlike your favorite horror movie, there's no hitting pause!
Here's how to survive the countdown:
- 45 Days to Identify: You have 45 calendar days from the sale of your relinquished property to identify potential replacement properties in writing.
- 180 Days to Complete: You generally have 180 calendar days from that same sale to complete your Exchange, or until your applicable tax return deadline (including extensions), whichever comes first.
- Don't Become a Deadline Zombie: Missing an important deadline could cost you the tax deferral you were counting on.
The real nightmare? Thinking you have 45 PLUS 180 days. You don't!
Don't let the clock run out on your Exchange.
Not all 1031 Exchanges are created equal... and there's more than one way to work your tax-deferral magic!
The Classic Potion (Delayed Exchange) : Sell first, buy later! The traditional 1031 Exchange lets you sell investment property and acquire qualifying replacement property while deferring capital gains taxes.
The Reverse Spell (Reverse Exchange): Found your dream investment property before selling your current one? A Reverse Exchange may let you buy first and sell later through a specially structured transaction.
The Haunted House Makeover (Improvement Exchange): Found a property with potential, but it needs a little magic? An Improvement Exchange may allow you to use Exchange funds toward qualifying improvements.
The Ultimate Witch's Brew (Blended Exchange): Sometimes one potion isn't enough! A Blended Exchange combines exchange strategies to accommodate more complex transactions.
No magic wand required, just the right Exchange strategy!
Lights, Camera... Tax Deferral
Grab your popcorn! The 1031 Exchange Brothers are here to take the horror out of tax deferral. From spooky deadlines to costly mistakes, tune in for real answers to the exchange questions keeping investors up at night.
Don't Let Tax Season Sneak Up on You!
The scariest surprise isn't always hiding under your bed... sometimes it's hiding in your tax return deadline!
If you're starting a 1031 Exchange late in 2026, listen up!
Your Exchange must generally be completed within 180 days of selling your relinquished property OR by the due date of your 2026 income tax return (including extensions), whichever comes first.
If your 180-day deadline extends beyond your regular tax filing deadline, you may need to file an extension to preserve the full Exchange period.
Don't let an early tax filing turn your Exchange into a nightmare!
